Foreigners buying property in Malaysia: an agent’s process checklist

Establish the state, property category, buyer status and State Authority consent requirements before discussing signing and payments. Do not apply one state’s price threshold or procedure nationwide.
Screen eligibility before recommending a home
Check the state, land category, title restrictions, buyer status and applicable threshold. The federal land department identifies State Authority consent for acquisition by a non-citizen or foreign company. This checklist does not replace state rules; Sabah, Sarawak and special programmes require their respective checks.
Begin legal and funding checks before committing
Ask the lawyer to check title, consents, contractual conditions and what happens if approval is refused. Ask the bank to confirm financing eligibility and funding arrangements. Eligibility under MM2H or another residence programme is not proof that a particular unit is approved for purchase. Do not promise a fixed approval time.
Record the process, costs and ongoing management
Have the lawyer establish the applicable sequence: eligibility and title checks, contractual arrangements, consent applications, financing and duties, transfer or relevant rights documentation, and handover. The agent coordinates information rather than replacing legal judgement. Overseas buyers should also consider remittances, exchange rates, remote signing, management and eventual sale, with written cost estimates.
FAQ
Does meeting a price threshold allow purchase of any home?
No. State rules, property type, title restrictions and required approvals still need verification; price does not replace consent.
